Was the law expedient to Bobby Motaung's fraudlent?

Bobby Motaung and his co-director at Lefika Emerging Equity (Pty) Ltd, Herbert Theledi, looked relaxed as they approached the dock to appear on fraud and theft charges. The released Kaizer Chiefs manager Bobby Motaung and his co-accused director of Lefika Emerging Equity, Herbert Theledi are out of prison on bail of R50 000 each. They have been charged with forgery and fraud relating to the construction of the Mbombela 2010 FIFA World Cup stadium. Lefika allegedly committed fraud in securing the tender to build the stadium.

This is very astounding to see that highly respected aristocrats commits fraud to fulfil their luxury lifestyle. The South African Criminal Law and Procedure: Common-law crimes, a book by John Milton states that "the law must consider fraud and theft cases as a false pretence. The accused's conduct would be justified as a fraud conviction which must then result for a repulsive verdict to his or her conviction, a sentence must be declared to any citizen who is the source of illegal implications." In my professional opinion, I believe that  the law must take its course to anyone who has not adhered to legal practises of a particular country. Despite the fact that the rich or poor person has broke the law, the verdict must favour equally.  This has caused so much controversy, and makes the news because the Mbombela protesters, were dressed in an African National Congress (ANC) T-shirts, chanting a loud rhythm 'Dubula u Bobby' (Shoot Bobby) outside the Nelspruit Regional Court, where Motaung was appearing on charges of fraud. Now that Motaung is a prominent person, it is going to take time to rebuild his reputation and to convince the public that he is worth of their support and approval. This requires a role of a well trained publicist who will positive disseminated information at all costs to the media to reform his image and that people will believe him again, because such things must not be neglected.

Its a good thing that Kaizer Chiefs fans turned out in support of Motaung, after such scandalous and disillusionment behaviour from the person they looked up to. Fraud is an intentional deception resulting in injury to another person or an organisation. What Motaung and his director is unforgivable; he must be prosecuted like any other person who would have committed such a crime. The law is South Africa is not fair, because it favours those who are rich resulting to them not serving their jail time while the other poor citizens, rot in jail certainly for things that they were never guilty of. Do you thing the law is expedient to the riches? Whats your take on this, do you think Motaung and Theledi should be prosecuted?

  1. this is shameful, i rely do not understand why powerful [people are so greedy. this is all greed and selfishness, why cant people work hard to get what they want but instead they are stealing from the government, this money could have covered something else or the tender could have been awarded to some who deserves it.

    1. No, in this country if you poor you remain poor because those who are rich will always suppressing the poor with their greediness. Its not fair that people do fraud to get tenders that worth tons of millions, Bobby is greedy

  2. Bobby and partner dug their own graves! Thanks for this blog as I was curious to read more cause on radio past day they wouldn't give names of the high profile person accused of fraud. Now I know

    1. Did they real dug their own graves? I don't think so, because if they did they would be free from jail, first of all they weren't supposed to be granted bail from the first place, because they are supposed to pay for what they did. But guess, what the law is expedient, it rules in favour of the elitists like bobby and politicians

  3. This is very shocking to see one of the well known Kaizer Chiefs manager involved in this fraud. This just shows that some people are just greedy and never get enough of the salary they already earn.

    1. Greediness is what leads to people commiting crime and I don't think that some people appreciate what they have and that they go beyond to committ crime, fraud so that they fulfil their lavish lifestyles

  4. I believe in the saying that goes, all done in the dark shall be revealed. This is a sign of total greed and the facts that even if you have money, you will always want even more.

    1. I also belive that too, becaus e whatever you do in the dark , becomes exposed, so this debacle is scandalous and sure has tarnished his reputation and its going to take take time to restore all of that

  5. People in high positions are used to comitting fraud and getting away with it. Bobby and his partner must really face the music and get punished for what they did.

    1. Well, I boubt that they'll ever get punished because they've been granted bail already which means they might not serve jail-time as well. The law is this country is biased

  6. Today's businesses are runned under the table with brown envilopes.People get rich by doing wrongs things to live fensy lifestyle.Something has to be done about this issue.

    1. yes, something effective has o be done to stop fraud and crime to this country, I mean I always ask myself of what is the image these people portray in the public and to upcoming entrepreneus, when they see that to get a business you have to commit fraud. This is the perception they building to youngsters rthat its cool to commit fraud

  8. undoubtedly Mr Motoung has embarrassed the image of Kaizer chiefs he must be suspended untill the investigations finish then he must also apologies to the country.

    1. Even those investigations will be done with bribery to cover the scam that he has done, so I thing investigating this matter will cause a huge controversy or else they must get someone or a specialist to do the job and not the government official

Regardless of the status or the amount of power an individual upholds at the end of the day it is clearly stated in the visiob statement of the country that we are all equal n therefore we should be treated the same. He must be responsible for his actions and serve a jail sentence like how an ordinary south african would.

  10. Bobby Motaung may be the son of a well known business man and he has also made a name for himself in the sport industry but he should be held responsible for his actions, just like an ordinary South African would.
